Nunies v. HIE Holdings, Inc., 16-16494
In an amended opinion, reinstated a delivery driver's claim that his employer erroneously regarded him as disabled in violation of the Americans with Disabilities Act. The driver alleged that he was forced to resign after injuring his shoulder. Reversing summary judgment in relevant part, the Ninth Circuit clarified the impact of the ADA Amendments Act of 2008 on the definition of regarded-as disability.
