American Freedom Defense Initiative v. King County, 17-35897

Held that metropolitan transit officials did not have a legitimate reason for rejecting a proposed advertisement concerning global terrorism for display on the exterior of city buses. The officials contended that the ad submitted by a political organization was disparaging and could disrupt the transit system. Unpersuaded, the Ninth Circuit concluded that the officials' reasons for rejecting the ad did not withstand First Amendment scrutiny. The panel remanded with instructions to enter summary judgment for the plaintiffs.
