O'Connor v. Uber Technologies, Inc., 14-16078
Held that the ride-sharing service Uber was entitled to compel arbitration of multiple consolidated lawsuits brought by Uber drivers who alleged that they were misclassified as independent contractors rather than employees, among other claims. Uber contended that it had a right to compel arbitration of these lawsuits based on Mohamed v. Uber Technologies, Inc., 848 F.3d 1201 (9th Cir. 2016). The Ninth Circuit agreed, rejecting the arguments of the current and former drivers. Because the actions now would have to be arbitrated, the panel also reversed an order granting class certification in one of the cases.
