United States Ninth Circuit

Sanchez v. Sessions, 14-71768

Granted an alien's petition for review of a removal decision. The Mexican citizen argued that he was seized solely on the basis of his Latino appearance and therefore the government's evidence of his alienage was improperly used against him. Finding merit in his arguments, the Ninth Circuit remanded for further proceedings, with instructions that the agency may consider whether the violation was sufficiently egregious to warrant terminating removal proceedings without prejudice.
