Nunies v. HIE Holdings, Inc., 16-16494

Reinstated a delivery driver's claim that his employer erroneously regarded him as disabled in violation of the Americans with Disabilities Act. The driver alleged that he was forced to resign after injuring his shoulder. Finding genuine issues of material fact on his disability discrimination claim, the Ninth Circuit reversed summary judgment in part. The panel's opinion clarifies the impact of the ADA Amendments Act of 2008 on the definition of regarded-as disability.
