United States Ninth Circuit
US v. Lynch, 10-50219
Affirmed a defendant's conviction of federal drug charges related to his ownership of a marijuana dispensary in California. The defendant contended that the district court made various errors, including trying to dissuade the jury from engaging in nullification. He also argued that his conviction was annulled by the U.S. Congress' recent appropriations rider prohibiting the federal prosecution of persons for activities compliant with state medical marijuana laws. In a 2-1 decision, the Ninth Circuit affirmed his conviction but remanded for further factual findings relating to the appropriations rider issue.
