United States Ninth Circuit

US v. Franklin, 17-30011

Vacated a mandatory minimum sentence imposed under the Armed Career Criminal Act. The defendant argued that he was not subject to a 15-year mandatory minimum sentence for being a felon in possession of a firearm because his three Washington convictions could not constitute serious drug offenses. Persuaded, the Ninth Circuit vacated his sentence and remanded to the district court for resentencing.
