United States Ninth Circuit

Democratic National Committee v. Reagan, 18-15845

Rejected a challenge to two Arizona election practices: (1) refusing to count ballots cast in the wrong precinct, and (2) precluding most third parties from collecting early ballots from voters. The Democratic National Committee and its co-plaintiffs brought this lawsuit asserting that these practices are unconstitutional and violate the Voting Rights Act. The district court rejected those contentions after a trial, and the Ninth Circuit affirmed in a 2-1 decision.
