United States Ninth Circuit

Martinez v. Cate, 15-16433

Reversed the denial of habeas relief. The defendant contended that his statements should not have been used against him at trial because when he invoked his right to counsel during custodial interrogation, the officer did not immediately cease questioning. Finding merit in his arguments, the Ninth Circuit reversed the denial of habeas relief and remanded.
