California Trucking Association v. Su, 17-55133
Affirmed the dismissal of a trucking industry trade group's lawsuit seeking a declaration that the California Labor Commissioner is not permitted to apply a common law test in determining whether a motor carrier has properly classified its drivers as independent contractors. The trade group contended that a federal law regulating motor carriers preempts the common law test. Unconvinced, the Ninth Circuit rejected the trade group's preemption argument and affirmed dismissal of its lawsuit.
