United States Ninth Circuit

Held that a defendant should be allowed to withdraw his guilty plea to charges of illegally reentering the United States. The defendant argued that he should be permitted to withdraw his guilty plea because the Supreme Court's decision in Sessions v. Dimaya, 138 S. Ct. 1204 (2018), undermined the basis for his indictment. Persuaded, the Ninth Circuit vacated and remanded with instructions to permit him to withdraw his guilty plea.
