US v. Kechedzian, 16-50326

Reversed a conviction on the ground that a juror should have been excused for cause under an actual bias theory. The defendant, who was convicted on charges including aggravated identity theft, argued that the district court erred by refusing to dismiss a prospective juror who never unequivocally stated that she could be fair and impartial. Agreeing, the Ninth Circuit held that the challenged juror should have been excused for cause under an actual bias theory. The panel reversed and remanded for a new trial.
