US v. Peterson, 17-30084
Vacated a sentence for being a felon in possession of a firearm upon finding that the district court applied an improper sentence enhancement under the U.S. Sentencing Guidelines. The defendant contended that it was error to treat his prior Washington first-degree robbery conviction as a crime of violence. Agreeing with him, the Ninth Circuit vacated and remanded for resentencing. However, the panel affirmed the denial of his motion to suppress the handgun evidence.
