Montana Environmental Information Center v. Thomas, 16-71933
Denied a petition for review challenging the U.S. Environmental Protection Agency's approval of a revision to Montana's State Implementation Plan. An environmental organization contended that the EPA's approval was arbitrary and capricious because Montana interprets one of its air quality provisions less stringently than the Clean Air Act would allow. Rejecting the environmental organization's arguments, the Ninth Circuit denied the petition for review.
