US Ex Rel. Scott Rose v. Stephens Institute, 17-15111

Affirmed a decision denying the defendant’s motion for summary judgment in an action brought under the False Claims Act. Plaintiffs, former admissions representatives for the Academy of Art University in San Francisco, brought suit alleging a violation of an incentive compensation ban. The Ninth Circuit concluded that the evidence indicated that defendants did violate the incentive compensation ban and that there was no safe harbor.
