US v. Bankston, 16-10124

On a government appeal, vacated a sentence for felon in possession of a firearm and remanded for resentencing. The government argued that the defendant's prior California robbery convictions should have been considered crimes of violence under the U.S. Sentencing Guidelines, and that the district court erred in holding to the contrary. Persuaded by this argument, the Ninth Circuit also explained that the relevant portion of recent Amendment 798 to the Sentencing Guidelines was not retroactive.
