Nguyen v. Sessions, 17-70251

Granted a lawful permanent resident's petition for review of a decision ordering him removed from the United States. The Board of Immigration Appeals had found that the Vietnam citizen was ineligible for cancellation of removal because he admitted to using cocaine in 2005, which meant he did not have seven years of continuous residence without the commission of an offense. On appeal, the Ninth Circuit held that the Board misapplied the relevant cancellation-of-removal provision. The panel noted that its interpretation of the provision differed from the Fifth Circuit's.
