United States Ninth Circuit

Affirmed a defendant's conviction for illegal reentry in a case where the defendant was originally deported for a conviction that was determined to be a crime of violence. In affirming, the Ninth Circuit rejected the defendant's argument that his conviction for assault with a deadly weapon was not a crime of violence because there was no intentional use of force and it therefore found that his deportation was lawful.
