United States Ninth Circuit

Affirmed a conviction for illegal reentry into the United States of a man who previously had been deported. The Mexican citizen argued that he was not guilty of illegal reentry because his initial deportation was unlawful, in that his Nevada conviction of battery committed with the use of a deadly weapon was not an aggravated felony. Rejecting his argument, the Ninth Circuit affirmed.
