Moore v. Urquhart, 16-36086

Held that tenants could proceed with a constitutional challenge to a Washington statute that in some circumstances allows evictions without a court hearing. The plaintiffs in this proposed class action were two tenants who argued that the statute, Washington Revised Code section 59.18.375, violates the Due Process Clause of the Fourteenth Amendment by authorizing eviction without mandating a court hearing beforehand. On appeal, the Ninth Circuit agreed with the tenants that the trial court erred in dismissing the case on the pleadings, and rejected the defendants' mootness and other arguments.
