Johnson v. Montgomery, 15-56007

Affirmed denial of a state prisoner's habeas petition challenging sentencing enhancements. The prisoner, who was convicted of robbery, argued that there was insufficient evidence to support a sentencing enhancement for a gang-related crime and that the enhancement for his nonjury juvenile conviction violated Apprendi v. New Jersey, 530 U.S. 466 (2000). Finding no error, the Ninth Circuit affirmed.
