United States Ninth Circuit
Gila River Indian Community v. US Department of Veterans Affairs, 17-15629
Affirmed dismissal of an Indian tribe's claim that the Department of Veterans Affairs must reimburse it for the care it provides veterans at its tribal facilities. The tribe argued that two provisions of the Patient Protection and Affordable Care Act require such reimbursement even absent an agreement defining the terms of reimbursement. Agreeing with the federal government, the Ninth Circuit held that the Veterans' Judicial Review Act deprived the district court of subject matter jurisdiction over the tribe's claims.
