United States Ninth Circuit

Held that two individuals adequately stated a claim that United States Customs and Border Protection unlawfully confiscated photographs they took of activities at U.S. ports of entry on the U.S.-Mexico border. The U.S. citizens contended that the government could not impose restrictions on photography in the public, outdoor areas where the photos were taken. On appeal, the Ninth Circuit held that the individuals had adequately pleaded First Amendment claims, and thus reversed the district court's dismissal of their amended complaint.
