Clark v. City of Seattle, 17-35693

Affirmed the dismissal of a lawsuit brought by a group of Uber and Lyft drivers to challenge a 2015 Seattle ordinance that established a multistep collective-bargaining process between drivers and ride-sharing companies. The drivers, who objected to being represented by a labor union, argued that the ordinance violated their First Amendment rights and also was preempted by the National Labor Relations Act. On appeal, the Ninth Circuit agreed with the lower court that the drivers' claims were constitutionally unripe because they did not allege any concrete and particularized injury.
