Alvarez-Cerriteno v. Sessions, 16-73486
Vacated an administrative decision ordering a lawful permanent resident removed from the United States. The Board of Immigration Appeals had found that the Mexican citizen was removable based on his Nevada child abuse conviction for punching his 14-year-old son. On appeal, however, the Ninth Circuit held that Nevada's definition of child abuse is broader than the Immigration and Nationality Act's and, therefore, the Board erred in equating them. The panel granted the petition for review and remanded for further proceedings.
