United States Ninth Circuit

Hornish Joint Living Trust v. King County, 16-35486

Affirmed summary judgment against private landowners in a dispute regarding the boundaries of a hiking and biking trail built along the path of an old railroad easement. The landowners, whose properties abutted the rail corridor, sued the county government to challenge the nature, scope, and width of the corridor covered by the easement. The county counterclaimed asking the court to quiet title. On appeal, the Ninth Circuit agreed that the county was entitled to prevail.
