United States Ninth Circuit

US v. Ochoa-Oregel, 16-50413

Reversed a conviction of unlawful re-entry into the United States. The defendant, who had been a legal permanent resident, argued that his 2008 and 2011 removals were fundamentally unfair and violated due process and thus neither could serve as a predicate removal for purposes of an unlawful re-entry conviction. The Ninth Circuit agreed and reversed his conviction.
