Guo v. Sessions, 15-70617

Reversed the denial of a Chinese citizen's asylum claim which alleged that he would be persecuted for his Christian beliefs if he returned to China. The Ninth Circuit found that he presented compelling evidence of having been persecuted in the past for his religious beliefs. The panel therefore granted his petition for review and remanded to the Board of Immigration Appeals with instructions to apply the rebuttable presumption that he would experience further persecution if returned to China.
