United States Ninth Circuit
Tunac v. US , 17-15021
Affirmed the dismissal of a suit alleging that a Department of Veterans Affairs (VA) medical center caused a veteran's death by delaying urgently needed medical treatment. The veteran's spouse alleged negligence, but the Ninth Circuit held that, to the extend it had jurisdiction over her claims, the claims were barred by the Federal Tort Claims Act's statute of limitations and that some of her claims could be heard only by the Federal Circuit.
