Mendez v. County of Los Angeles, 13-56686

On remand from the US Supreme Court, the Ninth Circuit affirmed in part and reversed in part the district court’s judgment. The Ninth Circuit held that plaintiff’s Fourth Amendment rights were violated when police officers entered the shed where they were sleeping without a warrant and without knocking. Further, plaintiffs were entitled to recover damages from injuries they suffered when the officers opened fire, after, the plaintiffs roused from sleep and moved a BB gun. The court reasoned that the injuries may not have occurred if the officer’s entry into the shed had been constitutional.
