McGreevey v. PHH Mortgage Corp., 16-36045

Affirmed that a claim under the Servicemembers' Civil Relief Act was time-barred. A U.S. Marine filed suit under a provision of the Act that provides a limited prohibition on foreclosure of servicemembers' property. When his claim was dismissed on timeliness grounds, he appealed, arguing that the judge had applied the wrong limitations period. Rejecting his argument, though for reasons different from the trial court, the Ninth Circuit held that the four-year federal catchall statute of limitations barred his claim.
