Young v. State of Hawaii, 12-17808
Held that the Second Amendment to the U.S. Constitution protects a right to carry a firearm in public for self-defense. In this lawsuit, a gun owner challenged the constitutionality of a Hawaii statute that limits the open carry of firearms to people engaged in the protection of life and property, such as security guards. In a 2-1 decision, the Ninth Circuit held that the gun owner stated a claim that the statute violates the Second Amendment and the panel therefore reversed the dismissal of his claim and remanded.
