Segalman v. Southwest Airlines Co., 17-15196
Affirmed the dismissal of a disability discrimination claim brought by an airline passenger under the federal Air Carrier Access Act of 1986. The passenger alleged that the airline had mishandled his wheelchair in violation of his rights under the statute, which prohibits air carriers from discriminating against individuals on the basis of a physical or mental impairment. However the Ninth Circuit, joining other circuits, held that the ACAA's anti-discrimination prohibition is not enforceable through an implied private cause of action.
