Affirmed a conviction for possession of a firearm by a felon in a case where there was allegedly a problem with the arrest warrant. The defendant argued that the district court should have granted his motion to suppress. However, the Ninth Circuit concluded that the good-faith exception to the exclusionary rule applied because the police officers executing the infirm warrant were unaware, and had no reason to be aware, of any judicial abandonment. On a separate issue, the panel held that it was not error to preclude the defendant from presenting a necessity defense.
