United States Ninth Circuit
Dutta v. State Farm Mutual Auto. Ins. Co., 16-17216
Affirmed summary judgment dismissing a claim under the Fair Credit Reporting Act brought by a job applicant who was rejected for a job based on errors in a credit report. In affirming the dismissal, the Ninth Circuit held that he lacked Article III standing because he failed to making a showing of concrete harm from the failure to provide him the statutorily required notice about the use of the credit report, given that his poor credit history would have disqualified him from the position regardless.
