US v. Buenrostro, 16-10499
Affirmed the denial of a motion for a sentence reduction and a motion to vacate a sentence filed by a defendant who had previously been granted a commutation from a life sentence to 360 months in prison. With his motions, the defendant sought further modification of his sentence under 18 U.S.C. section 3582(c)(2), but in rejecting his argument, the Ninth Circuit held that the statute was inapplicable because he was originally sentenced based on a statutory mandatory minimum, not based on a sentencing range.
