US v. Pepe, 14-50095
Vacated a criminal conviction and the sentence of a U.S. citizen who allegedly drugged and raped several children while he was residing in Cambodia. In reversing, the Ninth Circuit held that the defendant was improperly convicted of violating 18 U.S.C. section 2423(c) because the version of that statute in effect during the relevant time period was inapplicable to U.S. citizens living abroad unless they were traveling (as opposed to residing) in the foreign country when they committed the sexual acts that the statute prohibits.
