U.S. ex rel. Silingo v. Wellpoint, Inc., 16-56400

Reversed the complete dismissal of a False Claims Act lawsuit where the plaintiff (qui tam relator) alleged that several Medicare Advantage organizations had submitted false claims for payment to the U.S. government. Because her allegations of factually false claims, express false certifications, and false records had been pleaded with particularity, those claims of wrongdoing should not have been dismissed on the pleadings. However, the Ninth Circuit determined that the district court correctly dismissed some of the plaintiff's other claims for relief, the appeals court held.
