Fleshman v. Volkswagen, 16-17060

Affirmed the denial of a motion to intervene filed by a Volkswagen owner in the federal government's Clean Air Act enforcement against Volkswagen. The court held that the Clean Air Act did not grant the plaintiff an unconditional right to intervene. The plaintiff could bring a separate suit under the Act, but had no statutory right to intervene in the government's enforcement action.
