Wheeler v. City of Santa Clara, 16-17375
Affirmed the dismissal of a complaint under the Americans with Disabilities Act by the son of woman killed by police officers during a 911 call. The district court dismissed the complaint because the biological son had been adopted by other parents as an infant and thus had no legal interest as a successor. The Ninth Circuit held that the California survival statute applied and plaintiff did not meet the requirements of standing under that statute.
