USA v. Brian Charette, 17-30059
Affirmed in part, reversed in part, vacated, and remanded for retrial. Defendant killed a grizzly bear that was harassing his horses in Montana and was convicted of violating the Endangered Species Act. The 9th Circuit held that the trial court erred in applying an objectively reasonable standard when it should have applied a subjective belief standard as to the defendant's claim of self-defense.
