Bermudez-Ariza v. Sessions, 15-72572

Remanded to the Board of Immigration Appeals which had vacated a grant of asylum by an immigration judge who subsequently granted asylum relief. The Board then vacated this grant of asylum stating that the IJ exceeded the scope of his jurisdiction. The 9th Circuit held that Board did not expressly retain jurisdiction when it remanded to the IJ and therefore the IJ had jurisdiction to grant asylum. Remanded for the Board to address the grant of asylum on its merits.
