Affirmed. In this labor law case the district court dismissed for lack of subject matter jurisdiction. The court of appeals held that section 301(a) of the Labor Management Relations Act grants jurisdiction only for suits that claim a violation of a collective bargaining agreement (CBA). In this case, the employer alleged that the union engaged in misrepresentation to induce it to enter into a CBA. The appellate court reasoned that plaintiff was not seeking enforce a CBA, but rather, to void it, something that is outside of section 301(a).
