United States Ninth Circuit

US v. Reinhart, 16-10409

In a criminal sentencing appeal, the 9th Circuit held that neither of the defendants prior convictions for possession of child pornography and sexual exploitation of a child in California constituted a prior conviction under 18 USC section 2252b2. Therefore, defendants current conviction of possession of child pornography was not subject to the ten year mandatory minimum sentence.
