Affirming in part and reversing in part the district court's summary judgment and remanding an action alleging that police officers used deadly force when they shot a man after responding to a call about a man acting erratically and brandishing a pair of scissors because a reasonable jury could conclude that the man was not an immediate threat to the officers, who were behind the cover of their vehicles and outnumbered the man eight to one, though the officers were entitled to qualified immunity, that a reasonable jury could find a Fourth Amendment violation, and that the defense was not entitled to summary adjudication of the Americans with Disabilities Act and Rehabilitation Act, reversing district court rulings to the contrary.
