Denying an application to file a second or successive habeas petition in which the applicant claimed that the State of California had suppressed materially exculpatory evidence unavailable to him when he first petitioned for habeas relief because the panel found that the applicant failed to show that he had exercised due diligence in failing to discover the allegedly suppressed evidence at the time of the first habeas petition and that even if he had the application would be denied because the new evidence didn't make a prima facie showing of actual innocence.
