United States Ninth Circuit

Sali v. Corona Regional Medical Center, 15-56460

Reversing a district court denial of class certification in a putative class action by Registered Nurses against a medical center alleging employment claims because, in determining the certification of a class, the court could not decline to consider evidence simply because it was inadmissible at trial and while they agreed that a party was not an adequate class representative, that wasn't a valid basis to deny certification. They also held that the court abused its discretion in finding a law firm was not adequate class counsel, a decision that was premature, and the court erred in denying certification of claims under the predominance requirement.
