United States Ninth Circuit

US v. Kootswatewa, 16-10228

Affirming a man's conviction in the case of the sexual abuse of a developmentally delayed minor because the collection of statements from the victim by a nurse practitioner were made for the purpose of medical diagnosis and the district court properly exercised its discretion in admitting the defendant's statements to a law enforcement officer in order to rebut defense counsel's suggestion that the victim's testimony had been tainted by the mother's coaching because it established the consistency of her testimony.
