Thompson v. Rahr, 16-35301

Affirming the district court's grant of summary judgment on qualified immunity grounds in a case alleging that a police officer's having aimed a gun at a plaintiff's head during a felony arrest after the plaintiff had already been searched and was calm and compliant because although, given the circumstances, the use of force was excessive under the Fourth Amendment, qualified immunity applied because the plaintiff's right not to have a gun pointed at him was not clearly established.
