In Re USA, 17-71692

Denying without prejudice the petition for writ of mandamus in which federal defendants sought an order directing the district court to dismiss a case seeking environmental remedies in a massive climate change constitutional suit because an allegedly burdensome discovery process would not threaten separation of powers, a position that was premature given that the district court hadn't issued a single discovery order and the plaintiffs hadn't filed a single discovery motion.
